NOTICE OF HEARINGS and SITE VISITS

May 19, 2016
To all Persons owning land or interested in lands along:
Taylor Road (TH#18),
Legal Trail #1 (runs between Taylor Rd. & Old County Rd.)
Mill Terrace (TH#82)
and the Peacham Planning Commission, and the Public:

At a regular meeting on 5/4/16 the Peacham Selectboard initiated the 19 V.S.A. §708 process to:
  1. Discontinue Taylor Road (TH#18)
  2. Discontinue Legal Trail #1 (running from Taylor Rd to Old County Rd.)
  3. Reclassify a portion of Mill Terrace (TH#82) to a Legal Trail; the proposed portion for reclassification runs from the Peacham-Barnet Road northerly to a point 25 feet past the northerly bridge abutment.

The Selectboard appointed the date of Wednesday, July 6, 2016 for site visits and hearings pursuant to 19 V.S.A. §709, beginning at 5:00 pm and continuing in the following order at the following approximate times (each directly following the previous site visit):

5:00 PM to examine Mill Terrace (TH#82) at or near the bridge at the intersection with the Peacham-Barnet Road, and begin the hearing to receive testimony. The hearing will then be temporarily adjourned and reconvene later the same evening at the Peacham Town Hall.

5:30 PM to examine Taylor Road (TH#18) a short road that runs between the Peacham-Danville Road and the start of Legal Trail #1, and begin the hearing to receive testimony. The hearing will then be temporarily adjourned and reconvene later the same evening at the Peacham Town Hall.

5:45 PM to examine Legal Trail #1 beginning at the southeastern end of Taylor Road (the legal trail runs to and from Taylor Road and the Old County Road), and begin the hearing to receive testimony. The hearing will then be temporarily adjourned and reconvene directly afterward at the historic Ewell Mills site, then possibly the intersection with Old County Road upon request, and then the Peacham Town Hall.

6:30 PM to examine the historic Ewell Mills 3-acre site located along the Peacham Hollow Brook on the southeast side of the Peacham-Danville Road (located between Taylor Road and the East Peacham Road, across from Ewell Mill Road) and continue to receive testimony. It is proposed the Town acquire this site by gift, after it is landscaped for historic preservation and recreational use including parking, picnicking, walking, swimming, fishing including an ADA-compliant ramp access to the brook. The hearing will then be temporarily adjourned and reconvene later the same evening at the Peacham Town Hall.

7:30 PM (or directly following all the site visits) to reconvene the aforesaid hearings at the Peacham Town Hall meeting room or gym for the final portion of the hearings.

Written testimony may also be submitted to the Selectboard, Peacham Town Clerk’s Office, PO Box 244, Peacham, VT, 05862 (or delivered by hand to the Town Office at 79 Church Street) which must be received no later than 8:30 pm July 6, 2016 to be considered.


19 V.S.A. §711 requires the Selectboard to issue a decision no later than 60 days after the inspection and hearing.

Notice of Site Visit and Hearings

NOTICE OF HEARINGS & SITE VISITS

FOR ROAD CHANGES IN PEACHAM

Published Notice to the Public:

The Town of Peacham initiated the process per 19 V.S.A. Chapter 7 to:

1) Discontinue Taylor Road (TH#18)

2) Discontinue Legal Trail #1 (running from Taylor Rd to Old County Rd.)

3) Reclassify a portion of Mill Terrace (TH#82) to a Legal Trail; the proposed

portion runs from the Peacham-Barnet Road northerly to 25 feet past the

It has been proposed the Town accept a gift the Ewell Mills site on the Peacham-

Danville Road for historic preservation and recreational access as part of this

The date for all site visits and hearings is Wed., July 6, 2016 starting at 5:00 pm at

Mill Terrace and continuing through the evening at the various sites with final

testimonies and last portion of the hearings at the Peacham Town Hall. Written

testimony may also be submitted by 8:30pm that date.

The meeting was called to order by Annette Lorraine at 6:33PM.

  1. Review and Approve Minutes of 5/4/16
    1. David and Annette made two amendments to the minutes. David moves to approve the minutes as amended. Annette seconds. So moved. All in favor.

  1. Village Pathway.
    1. Rodney Reis wanted to know if the pathway would remain grass. He was concerned as the dead grass in the path is unsightly, the path is not a straight path, and the path was not maintained adequately through the winter. He said that almost no one used it in the winter.
    2. Annette said that the Selectboard never made a decision. The Selectboard has a new board member. He was given emails from the public and minutes from former meetings about this issue so he could review.
    3. David said the Selectboard can reseed the path. Annette said it might be premature because the path might become staymat for safety reasons.
    4. The Selectboard will make a decision on this issue at the June 1, 2016 regular meeting.

  1. Peacham Pond
    1. Steve said the pond he was referring to was at the corner by the Jensen’s. He said that you bottom out now and then from the pond like situation and you can’t see the problem until you are in it. The Selectboard and Jeremy discussed options to remedy the situation and will pursue a solution. That short stretch of road is likely not a road (it is not on the town map and the Jensen’s say it is part of their land). Closing it is a possibility as is taking a backhoe up there to get it to drain.

  1. Roller Barn Progress
    1. Ray still planning to finish the work before end of May. Tim will call to check in with him.

  1. Potential electrical work for exterior of town office building - second estimate
    1. David shared both bids with the Selectboard
      1. CFW’s is more affordable.
      2. Annette moves to accept CFW electric’s proposal. David seconds. So moved. All in favor.

  1. Re-adopting policies in the policy binder that are not signed
    1. Tom brought in the policy binder. He will leave it in the Selectboard box in the town office and all Selectboard members will come in and look between now and the next meeting.
  1. Legal trail closure process
    1. There will be a site visit and hearing on July 6th. The site visit will start at 5pm at Mill Terrace and Peacham Barnet Rd. At 5:30pm there will be a site visit at Taylor Rd, including the Legal Trail through the Vilandre-Cavanaugh property. After that there will be a Ewell Pond mill site visit. The hearing will follow Taylor site visit and will be at town hall.
    2. David moves to amend the motion from 5/4/16 - instead of discontinuing Mill Terrace Road, the Selectboard moves to begin the process to  reclassify that section of the road to a legal trail. Tim seconds. So moved. All in favor.

  1. Using the town gym for one day events
    1. The Selectboard decided that the town hall gym can be used for events by donation.

  1. Hazard mitigation plan committee suggestions
    1. Marty Cavanaugh volunteered to join the committee.
    2. The Selectboard is seeking additional volunteers.
  1. Request to allow parking on town property
    1. Tom is hoping to start wagon rides once a week in the village. He would like permission for people to park by the monument at the top of Church St on the grass. The Selectboard will allow it on a trial basis for 2016.

  1. Town Clerk Update - N/A

  1. Highway Department update
    1. Jeremy gave the Selectboard a draft of the bid for the paving project.
    2. The bid will go out tomorrow.
    3. Jeremy said that the road crew is  working on summer maintenance and are working on class 4 roads as people are coming up for the summer. Annette said that Hookerville Cutoff looks great.

The meeting was called to order by Chair of the Board Annette Lorraine at 6:33P.M.

    1. Tim moves to approve the minutes of 4/20/16. Annette seconds. So moved. All in favor.

  1. Town Highway Department
    1. Peacham received the Class 2 Roadway Paving Grant. Jeremy will stockpile gravel from the project at the transfer station in an out of the way location. By the next meeting, Jeremy will try to have an RFP for bids on part of the work ready for the Selectboard to review.
    2. Jeremy reminded the Selectboard that the loader was past its predicted life span by about 30%. He said that it is going to probably be about $100,000 to replace and the town might be able to get $30,000 for the old one. Tom said that due to tax sales and reduced education liability, the town should be $60,000 ahead this year, so should be able to purchase the loader without an increase in taxes.
    3. David said that he has received incredible praise for the road crew and he wanted to pass that along.

  1. Roller Barn Progress
    1. David said that there are barn boards up there and the beam was installed. Ray said he will finish by end of May.

  1. Potential electrical work for exterior of town office building
    1. David had another contractor look at it yesterday. Will have his estimate by the next meeting and will add it to the agenda.

  1. Hazard Mitigation Plan committee suggestions
    1. Melissa will post a volunteer add on bulletin boards and online. She checked in with Bruce Melendy for a little more details.

  1. Town Clerk Update
    1. Tom said he is finishing up recommendations from the 2011 audit. He said that the town is going to try to start taking money online via credit cards for permits, taxes, etc.
    2. Tom is writing a how to handle cash policy. He would like to add the following to the next meeting agenda: re-adopting policies in the policy binder that are not signed.
    3. Annette wants to increase fines for dogs as the current fines do not cover the costs associated with fining someone.
  2. Vilandre-Cavanaugh Taylor Road discussion and new potential public access opportunity
    1. They would like to discontinue the class 3 section and the legal trail section of Taylor Road that runs through their property for the safety of their family (vandalism is regular) and for the safety of stranded motorists following GPS or google maps. They believe they found a way to make it a win win situation for the town as well. In addition to saving the town about $3,000 a year in road maintenance on the Class 3 portion of road, they would like to give a 3 acre parcel that contains a historic site to the town of Peacham. They are willing to pay for the initial development costs to create a recreational area, with walking trail past old mill foundations, a couple of swimming holes and fishing access, parking, and an ADA compliant access for individuals with mobility access.
    2. The Selectboard and the public discussed the site. They all agreed that it has historical significance. Dale Roy shared stories of when the mills were still operating on that site when he was a kid.
    3. The Selectboard decided to conduct a site visit as it was still light out.

  5. Field trip to Peacham-Danville Road/Taylor Road area to see proposed public access opportunity.
    1. Ed and Marty gave a tour of the site. It was a beautiful location with a lot of possibilities. The Selectboard thought that it would be a good opportunity for the town and its residents.
    2. David moves to discontinue Taylor Rd from Peacham Danville Rd, including the Class 3 (rd #18) and legal trail (rd #1) sections, to the boundary of the Vilandre-Cavanaugh property line. Tim seconds. So moved. All in favor.
    3. David moves to discontinue Mill Terrace Road (rd #82) from the Peacham Barnet Rd to the north side of the bridge. Tim seconds. So moved. All in favor.

Planning Commission Meeting 5/3 is cancelled
